Review of Legislative Drafting and Policy-Making Process in Lebanon

Challenges:

Lebanon’s complex governance structure and fragmented institutional framework have long posed challenges to coherent policymaking and legislative drafting. The absence of unified procedures and limited coordination between ministries often led to overlapping regulations, delays, and inconsistencies in the legislative process.

Moreover, Lebanon had yet to adopt a Regulatory Impact Assessment (RIA) mechanism – an internationally recognized tool for ensuring that laws and regulations are based on evidence, stakeholder input, and cost-benefit considerations. There was a pressing need to analyze existing policymaking procedures, identify systemic weaknesses, and outline practical steps to improve regulatory quality and transparency.

Solutions:

To address these gaps, a review was commissioned by the SIGMA Programme (Support for Improvement in Governance and Management), a joint initiative of the Organisation for Economic Co-operation and Development (OECD) and the European Union. Arab African Advisers undertook this comprehensive review by:

  • Mapping the policy-making framework: Identify and analyze the main laws and regulations governing policy-making and legislative drafting within ministries.
  • Engaging stakeholders: Conduct interviews with key government officials to capture practical insights and challenges.
  • Process mapping: Develop a visual overview of the policy-making cycle and the key steps involved in drafting legislation.
  • Drafting analysis: Prepare a paper that outlined findings, to be discussed and refined with government officials.
  • Forward-looking recommendations: Propose options for introducing a RIA mechanism to enhance evidence-based decision-making.

 

Through this structured approach, AAA ensured that the recommendations were both technically sound and feasible within the country’s governance environment.

Impact:

The project provided Lebanese policymakers with a clear diagnostic of the existing legislative and policymaking framework, highlighting areas for improvement and reform.

By proposing practical options for introducing RIA, the review laid the groundwork for a more transparent, evidence-based, and coordinated policymaking process in Lebanon.

AAA’s work helped initiate a policy dialogue on modernizing regulatory governance, aligning Lebanon’s practices with international standards, and enhancing the effectiveness and credibility of its legislative process. AAA provided Lebanon with a roadmap for more transparent, efficient, and evidence-based policy-making and legislative drafting.
